These Terms of Use set out the terms governing the use of the website at https://zenovakimya.com (the “Site”) operated by Zenova Kimya Sanayi ve Ticaret Ltd. Şti. (“Zenova Kimya” or the “Company”). Every person who visits or uses the Site (a “User”) is deemed to have declared that they have read and accepted these terms. If you do not accept the terms, please do not use the Site.
Purpose of the Site
The Site has been created to provide general information about Zenova Kimya's products, application systems and technical content, and to receive quote requests and dealership applications. No direct sales are made through the Site. Quote requests do not constitute a binding order or contract; the terms of sale are determined by quotation, order or contract documents drawn up separately between the parties.
Intellectual Property Rights
All content on the Site, including the Zenova name and logo, product codes, texts, images, drawings, graphics, technical documents, software and design elements, belongs to Zenova Kimya or is used by Zenova Kimya under licence. This content is protected under the relevant legislation, in particular Law No. 5846 on Intellectual and Artistic Works and Industrial Property Law No. 6769.
Users may view the Site content solely for the purpose of obtaining information and selecting and applying our products, and may download and print technical documents for this purpose. Copying, reproducing, modifying, distributing or republishing the content, or using it in association with another product or brand, without the prior written permission of Zenova Kimya is prohibited.
Nature of the Technical Information
Unless otherwise stated, the product descriptions, technical data, mixing ratios, drying times and application recommendations on the Site reflect typical values obtained at a temperature of 20 °C and 65% relative humidity, together with general application experience. This information does not constitute a product specification or a warranty.
The actual performance of the products may vary depending on factors beyond Zenova Kimya's control, such as the condition of the surface, ambient temperature and humidity, film thickness, the equipment used and the application technique. Therefore:
- The current Technical Data Sheet (TDS) and Safety Data Sheet (SDS) for each product must be taken as the basis. In the event of any discrepancy between the Site content and these documents, the information in the current TDS and SDS prevails.
- A preliminary trial on a small area is recommended before applying a product to a large surface.
- It is the User's responsibility to assess, under their own conditions, whether the product is suitable for the intended use.
- For the safe use of the products, the warnings on the packaging label and the instructions in the Safety Data Sheet must be followed.
Recommendations provided by interactive tools such as the Product Selector are for general guidance only. You can access the current technical documents on the Technical Documents page and contact our technical support team with any questions about product selection and application.
Limitation of Liability
Zenova Kimya takes reasonable care to ensure that the information on the Site is accurate and up to date, but does not guarantee that it is complete, error-free or up to date at all times. The Site content may be changed without prior notice, and no undertaking is given that the Site will operate without interruption or error.
To the extent permitted by applicable legislation, Zenova Kimya cannot be held liable for any direct or indirect loss or damage that may arise from the use of, or inability to use, the Site, from decisions taken in reliance on the information on the Site, or from technical faults, interruptions, viruses or similar malicious software. This limitation does not exclude liability arising from wilful misconduct or gross negligence, or liability arising under mandatory rules of law.
User Obligations
The User agrees to use the Site in accordance with the law and these terms, to provide accurate information through the forms, not to share information belonging to others without permission, and not to make any attempt to disrupt the operation of the Site, threaten its security or overload it by automated means.
Third-Party Links
The Site may contain links to websites belonging to third parties. These links are provided for convenience only and do not imply that Zenova Kimya endorses those sites or their content. The content, availability and privacy practices of linked sites are the responsibility of their respective owners.
Personal Data
Information on the personal data processed while you use the Site is provided in the Privacy Policy, the Cookie Policy and the KVKK Information Notice.
Changes
Zenova Kimya reserves the right to update these Terms of Use at any time. Updated terms take effect on the date they are published on the Site. Your continued use of the Site means that you accept the current terms.
Governing Law and Jurisdiction
These Terms of Use shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye. To the extent permitted by Code of Civil Procedure No. 6100, the courts and enforcement offices of the place where the Company's head office is located (Nilüfer / Bursa, Türkiye) shall have jurisdiction over any disputes arising from these terms. The rights of Users who are consumers to apply to consumer arbitration committees and consumer courts under Law No. 6502 on the Protection of Consumers are reserved.
